The Pierfranco and Luisa Mariani Foundation undertakes to protect the digital privacy of its website users at all times. This document sets out the privacy policy of the Pierfranco and Luisa Mariani Foundation website (www.fondazione-mariani.org), explaining how personal data are managed when users access online services, specifically so that express and informed consent to the processing of personal data can be given in the sections of the website where this is required. These sections contain specific information pursuant to EU Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter the “Regulation”). Pursuant to the Regulation, data processing by the Pierfranco and Luisa Mariani Foundation on www.fondazione-mariani.org complies with principles of lawfulness, fairness, and transparency, and with the rights of data subjects. Personal data of users are processed in accordance with the legislative provisions of the aforementioned Regulation.

Data controller

Pursuant to and for the purposes of Article 24 of the Regulation, the data controller is the Pierfranco and Luisa Mariani Foundation – www.fondazione-mariani.org –, with registered office at Viale Bianca Maria 28, Milan, in the person of its legal representative. Data are processed by staff or collaborators of the Pierfranco and Luisa Mariani Foundation, who are formally appointed as data processors, and entrusted with the task of carrying out all activities, both direct and instrumental, necessary to ensure proper fulfilment of the Foundation’s institutional objectives.

The data controller has designated Dr Antonia Lotti, of “AL2 di Antonia Lotti sas”, as the data protection officer (DPO). The DPO can be contacted by e-mail at: info@fondazione-mariani.org.

Purposes of the processing

The personal data collected are processed by the Pierfranco and Luisa Mariani Foundation solely for the following purposes: 1. for sending newsletters on topics deemed to be of interest, or communications and documents concerning the Mariani Foundation’s activities; 2. for replying to specific questions submitted by data subjects; 3. for advertising or for promotional activities concerning the Foundation or its activities; 4. for enrolling participants in training events organised by the Mariani Foundation; 5. for processing donations received from data subjects.

Types of data provision

The provision of personal data is:

  • mandatory for the purposes indicated in points 2, 4 and 5: unless data are provided, the Mariani Foundation will not be able to reply to questions, process applications to enrol on courses, or receive donations;
  • optional for the purposes indicated in points 1 and 3: within the website there are boxes to be flagged to indicate consent.

Personal data subject to processing

Personal data processing means any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, restriction, and erasure or destruction. Personal data will not, in any case, be disclosed to third parties or disseminated, and will be processed in manner that ensures they are kept secure and confidential. In the case of users subscribing to the website’s news sections and newsletters www.fondazione-mariani.org, we process the following personal data: an online identifier, name, surname, telephone number and email address. When Mariani Foundation website subscribers register for training events, further data are processed: tax code, profession and residential address, collected through specific data fields. Furthermore, in the case of donations, the Foundation acquires the following personal data: name, surname and bank details. This website may contain embedded content (videos, images, articles, etc.) from other websites that may collect user data, use cookies, integrate further third-party tracking, and monitor interaction with the embedded content (see Cookie Policy). With regard to data acquired through its social media accounts (Facebook, Twitter, etc.), the Mariani Foundation uses all the measures at its disposal to guarantee correct processing of the same; nevertheless, these measures are conditioned by the very nature of these platforms, their usability, and the privacy measures implemented directly by the owners of the social media platforms (see Cookie Policy).

The user is further informed that the Pierluigi and Luisa Mariani Foundation is authorised to publish its own images on its website www.fondazione-mariani.org and also on social media platforms (Facebook) pursuant to articles 10 and 320 of the Italian Civil Code and articles 96 and 97 of Italian copyright law (law n. 633/1941).

Processing methods

Browsing data

Some personal data, automatically transmitted through the use of Internet communication protocols, are collected during normal browsing on this website (browsing data). This category includes IP addresses or domain names of computers used by users to connect with www.fondazione-mariani.org, the method used to submit requests to the server, and other parameters relating to the user’s operating system and computer system. These data are used anonymously and exclusively for statistical purposes. With the exception of what is here specified in relation to browsing data, users freely provide personal data by filling in data forms, as detailed below.

Data provided voluntarily by users

Data are processed using automated and non-automated means, in compliance with the confidentiality and security rules contained in the Regulation. Data provided voluntarily by users are collected through data forms on the website www.fondazione-mariani.org , which are used for:

  • registering on the website (click on “Register” on any page of the website);
  • enrolling on training courses
  • requesting information by email
  • making donations

In all cases, data are processed only by the data processors and the DPO who are appointed by the Pierluigi and Luisa Mariani Foundation in its capacity as data controller.

Data storage

We inform users that, in compliance with the principles of lawfulness, pertinence to the purposes of the processing, and data minimisation, set out in Article 5 of the Regulation, personal data are stored for the duration of the relationship with the Pierluigi and Luisa Mariani Foundation and for as long as they are needed to comply with administrative, accounting and organisational obligations. Personal data relating to purpose 1 (sending newsletters on topics deemed to be of interest, or communications and documents concerning Foundation’s activities) are stored until the user withdraws their consent; personal data necessary for purpose 2 (replying to specific questions submitted by data subjects) are stored only as long as the request is pending; personal data relating to purpose 3 (advertising or promotional activities concerning the Foundation or its activities) are stored until the user withdraws their consent; personal data relating to purpose 4 (enrolling participants in training events organised by the Mariani Foundation) are stored for 10 years; personal data relating to purpose 5 (processing donations) are stored for 10 years. Personal data will not, in any case, be disclosed to third parties or disseminated, and will be processed in a manner that ensures they are kept secure and confidential.

Rights of data subjects

Data  subjects data  have the right, at any time, to contact the Pierfranco and Luisa Mariani Foundation, Viale Bianca Maria n. 28, 20129 Milan, Italy (email: info@fondazione-mariani.org), in its capacity as data controller with responsibility for protecting personal data, in order to exercise their rights as set out in the following articles of the Regulation: 15 (access), 16 (rectification), 17 (erasure), 18 (restriction of processing), 19 (notification of rectification or erasure), 20 (data portability), 21 (the right to object), 22 (the right to reject profiling), and 34 (communication of a personal data breach).

Such requests must be made in writing and sent to the data controller or DPO at the address above.

This Privacy Policy came into effect on 01 July 2018. The Pierfranco and Luisa Mariani Foundation reserves the right to modify or simply update its content, in part or in whole, also due to changes in applicable legislation.
